Welcome to SyncRise AI. These Terms of Service explain how you may access and use our website, software, AI Employees, and related services. Our goal is to keep things clear, fair, and easy to understand.

By using the SyncRise AI website or services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services.

1. Who We Are

SyncRise AI is operated by Two by Eleven, LLC. Throughout this document, “SyncRise AI,” “we,” “our,” or “us” refers to Two by Eleven, LLC and its services.

Our platform provides AI-powered tools that help businesses handle customer communication, scheduling, follow-ups, and performance tracking.

2. Who Can Use Our Services

To use SyncRise AI, you must:

  • Be at least 18 years old
  • Have the legal ability to enter into a binding agreement
  • If you are signing up on behalf of a company, you confirm you have the authority to act for that business

Our services are intended for business use only, not for personal or consumer use.

3. What Our Services Include

SyncRise AI provides automation tools designed to help service businesses grow and operate more efficiently. Depending on your plan, services may include:

  • AI voice call handling
  • SMS, chat, and email automation
  • Lead response and scheduling
  • Customer follow-ups and database reactivation
  • Reputation and review management
  • Reporting, analytics, and performance insights
  • Integrations with CRM or marketing platforms

We may update, improve, or modify features from time to time to enhance performance.

4. Account Responsibility

Some features require you to create an account. When you do:

  • Provide accurate and current information
  • Keep your login details secure
  • You are responsible for all activity under your account

If you believe your account has been accessed without permission, contact us immediately at privacy@syncrise.ai.

5. Acceptable Use

You agree to use SyncRise AI responsibly. You may not:

  • Break any laws or regulations
  • Send unsolicited, deceptive, or unauthorized messages
  • Use the platform for spam or harassment
  • Upload harmful code, viruses, or malicious content
  • Copy, reverse engineer, or attempt to recreate our technology
  • Interfere with our systems or other users

We may suspend or terminate accounts that violate these rules.

6. Ownership and Intellectual Property

All software, content, branding, and technology provided by SyncRise AI are owned by Two by Eleven, LLC or its licensors.

Using our services does not give you ownership of our technology. You may not copy, distribute, or create derivative works without written permission.

7. Use of Artificial Intelligence

SyncRise AI uses automated systems to communicate, schedule, and analyze data.

By using our services, you understand that:

  • Some customer interactions may be handled by AI
  • AI responses are based on the settings, data, and workflows you provide
  • AI performance may improve over time through monitoring and optimization
  • AI output may not always be perfect or error-free

You are responsible for reviewing your configurations and ensuring your use of AI complies with applicable laws.

8. Communication and Consent Requirements

If you use our voice or SMS features, you are responsible for:

  • Obtaining proper customer consent
  • Following applicable communication laws, including TCPA and A2P requirements
  • Honoring opt-out requests immediately
  • Keeping records of customer consent

We may suspend services if messaging practices violate legal or carrier requirements.

9. Email Marketing Compliance

If you send marketing emails through SyncRise AI, you must:

  • Include your valid business address
  • Provide a clear unsubscribe option
  • Honor unsubscribe requests within 10 business days
  • Avoid misleading subject lines or content

You are responsible for complying with CAN-SPAM and similar regulations.

10. Payments and Billing

Some services require payment. By purchasing:

  • You agree to the pricing and billing terms in your order or agreement
  • You authorize our payment processor or us to charge your payment method
  • Payments are non-refundable unless stated in your Client Agreement or service policy

Failure to make payments may result in service suspension.

11. Third-Party Tools and Integrations

Our platform may connect with third-party systems such as CRMs, phone providers, or messaging platforms.

We are not responsible for the performance, availability, or privacy practices of third-party services. Your use of those tools is subject to their own terms.

12. Service Availability and Disclaimer

SyncRise AI is provided on an “as available” basis.

We do not guarantee:

  • Uninterrupted or error-free operation
  • Specific business results
  • That the service will meet every business need

To the extent allowed by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

13. Limitation of Liability

To the maximum extent permitted by law:

  • SyncRise AI is not liable for indirect, incidental, or consequential damages
  • Our total liability will not exceed the amount you paid for the service during the three months before the issue occurred

14. Indemnification

You agree to protect and hold harmless Two by Eleven, LLC and its team from any claims, damages, or costs resulting from:

  • Your use of the services
  • Your violation of these Terms
  • Your messaging or marketing practices
  • Your failure to comply with applicable laws

15. Suspension or Termination

We may suspend or terminate your access if:

  • These Terms are violated
  • There is suspected misuse or fraud
  • Your activity creates legal or operational risk

Termination does not remove your obligation to pay for services already provided.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland.

Any disputes will be resolved through binding arbitration in Maryland under the rules of the American Arbitration Association. You agree to waive class action and jury trial rights where permitted by law.

17. Changes to These Terms

We may update these Terms from time to time. When changes are made, the Effective Date will be updated.

Continued use of our services after updates means you accept the revised Terms.

19. Entire Agreement

These Terms, along with our Privacy Policy and any Client Agreement you sign, represent the full agreement between you and SyncRise AI.

If any part of these Terms is found invalid, the remaining sections will continue to apply.
